If you are a business using our platform, your use constitutes acceptance of these terms on behalf of your organization.
Answer Agent Pro ("Company," "we," "us," or "our") is an operator in the State of Oregon, United States. We provide AI-powered voice agent technology that allows small businesses ("Clients") to automatically answer inbound calls, capture caller information, qualify leads, and send appointment scheduling links via SMS to callers who have verbally consented during the call.
These Terms of Service ("Terms") govern your use of the Answer Agent Pro platform, website located at answeragentpro.com, and all related services (collectively, the "Service"). These Terms apply to two categories of users:
This section governs all text messages (SMS) sent by Answer Agent Pro or by Clients using the Answer Agent Pro platform. Answer Agent Pro operates two distinct SMS programs. All messages are strictly transactional. No marketing or promotional SMS messages are ever sent.
Who receives these messages: Individuals who called a business using the Answer Agent Pro platform and verbally consented during that call to receive a text message.
Message content: A single calendar booking link to schedule an appointment with the business the caller contacted.
Consent basis: Express verbal consent given during a live AI-answered call.
Message Frequency: 1 message per call interaction in which verbal consent is given. No recurring messages.
Message & Data Rates: Message and data rates may apply based on your carrier and plan.
Opt-Out: Reply STOP to unsubscribe. A single confirmation will be sent and no further messages will follow.
Help: Reply HELP or contact legal@answeragentpro.com.
Supported Carriers: All major US carriers are supported. Carrier participation may vary.
Who receives these messages: Business owners and operators who have created an Answer Agent Pro account and subscribed to the service.
Message content: Notifications that a new potential lead has called their business line, or that a caller has booked an appointment through the platform.
Consent basis: Written consent provided at the time of Answer Agent Pro account creation as part of the service agreement.
Message Frequency: Varies based on call volume. One notification per qualifying call event (new lead or booked appointment).
Message & Data Rates: Message and data rates may apply based on your carrier and plan.
Opt-Out: Reply STOP to unsubscribe. A single confirmation will be sent and no further messages will follow.
Help: Reply HELP or contact legal@answeragentpro.com.
Supported Carriers: All major US carriers are supported. Carrier participation may vary.
Caller Consent Process: The AI voice agent will explicitly ask callers if they would like to receive a text message with a booking link. Responding "yes" or affirmatively constitutes consent. No SMS will be sent to a caller without this affirmative verbal response.
Client Consent Process: Business Clients consent to receive lead and appointment notifications by agreeing to these Terms of Service at account creation. Clients may withdraw consent at any time by replying STOP to any notification message or by contacting us at legal@answeragentpro.com.
No Sharing of Consent: Consent given under either program does not extend to messages from any other business or for any unrelated purpose.
Client Responsibility: Clients using the Answer Agent Pro platform are responsible for ensuring their use complies with all applicable laws including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and carrier requirements. Answer Agent Pro provides the technical infrastructure; Clients remain responsible for lawful use.
To use the Answer Agent Pro platform as a Client, you must create an account and agree to these Terms. You represent and warrant that:
You are responsible for all activity that occurs under your account, including calls answered and SMS messages sent on your behalf through our platform.
Subscription Plans: Access to Answer Agent Pro is offered through paid subscription plans. Plan details, pricing, and features are described on our website and may change with reasonable notice. Your subscription begins upon account activation and renews on the applicable billing cycle unless cancelled.
Free Trials: We may offer free trial periods. At the conclusion of a free trial, your account will require a paid subscription to continue. We reserve the right to modify or discontinue free trial offerings at any time.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods unless required by applicable law.
You agree to use the Answer Agent Pro platform only for lawful purposes and in compliance with these Terms. You agree not to:
Answer Agent Pro reserves the right to suspend or terminate any account found to be in violation of these terms, without prior notice, and to report violations to relevant authorities.
By using our Service or calling a business that uses our Service, you acknowledge and agree to the following:
All content, technology, software, designs, logos, and materials on the Answer Agent Pro platform and website are the property of Answer Agent Pro or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose during your subscription period. You may not copy, reproduce, distribute, modify, or create derivative works from any part of our platform without express written permission.
Client Content: You retain ownership of any content, scripts, business information, or configurations you provide to customize the Service. By providing this content, you grant Answer Agent Pro a limited license to use it solely to operate and improve the Service on your behalf.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Answer Agent Pro does not warrant that:
Limitation of Liability: To the maximum extent permitted by applicable law, Answer Agent Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or lost opportunities, arising from your use of or inability to use the Service โ even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising from or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to Answer Agent Pro in the three months preceding the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Answer Agent Pro, its owner, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
Your privacy matters to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the terms of our Privacy Policy.
Of particular note: call recordings, transcripts, and caller information shared with Client businesses are described in the Privacy Policy. SMS consent records are retained for a minimum of 4 years in compliance with TCPA requirements.
Answer Agent Pro reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any of the following reasons:
Upon termination, your right to access the Service immediately ceases. We may delete your account data in accordance with our Privacy Policy and data retention practices. Sections of these Terms that by their nature should survive termination โ including Sections 7, 8, 10, 11, and 12 โ will survive.
You may terminate your account at any time by contacting us at legal@answeragentpro.com or through your account settings.
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the parties are unable to resolve a dispute through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction located in Oregon.
You agree to resolve any dispute on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration against Answer Agent Pro.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Answer Agent Pro regarding the Service and supersede all prior agreements or understandings.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Changes to Terms: We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and, where practicable, provide notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
